Terms of Service

The agreement between you and the Evidence Bank.

These Terms set out how membership works, what your £65.00 lifetime payment includes, and how the materials may be used.

1. Agreement

These Terms of Service ("Terms") govern your use of sendevidencebank.co.uk (the "Site"), operated by SEN Parent Support Group ("we", "us", "our"). By creating an account, purchasing membership or using any part of the Site, you agree to be bound by these Terms.

If you do not agree with these Terms, you must not use the Site.

2. Who the service is for

The SEND Evidence Bank is a library of exemplar materials, model wording, comparisons and checklists for parents, carers and professionals supporting children with special educational needs and disabilities (SEND) in England.

The Site is intended for adults. Accounts must be registered by a person aged 18 or over. The Site is not a service for children, and no information about any child should ever be entered into the Site.

3. Accounts

To access members' resources you must create an account with a valid email address and a password. You are responsible for keeping your password confidential and for all activity carried out through your account.

You must not share your account with any other person. Your membership is personal to you, and account sharing may result in access being withdrawn without refund.

You must provide accurate information when registering, and you may ask us to delete your account at any time.

4. Membership and payment

Lifetime membership is a one-time payment of £65.00. This is a single payment, not a subscription, no recurring charges will be taken.

Payments are processed securely by Stripe. We do not see or store your card details. Your lifetime access is activated automatically once your payment is confirmed, usually within moments of payment.

Because the paid-for resources are digital content that becomes available to you immediately on payment, and because the content is a one-off purchase rather than ongoing delivery, the 14-day cancellation right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 does not apply once you have accessed the members' resources. If you have paid but have not yet accessed any members' resource, contact us and we will consider a refund.

Where payment is taken in a currency other than pounds sterling, your bank or card provider may apply its own exchange rate and fees; we are not responsible for those charges.

5. What your membership includes

Lifetime membership grants you permanent, personal access to the current members' resources: Section B exemplars, Section F exemplars, weak-vs-strong comparisons, model reports, the tribunal bundle example and the searchable evidence library.

Lifetime means for as long as we operate the Site. If we ever discontinue the Site, we will provide reasonable notice by email so you can download or record anything you need.

We may add, update or withdraw individual resources from time to time as the law, guidance or case law develops. Access is to the library as it stands at any given time, not to a frozen copy of every page ever shown.

6. Licence to use the materials

All exemplars, comparisons, reports and other materials on the Site are owned by SEN Parent Support Group and are protected by copyright.

We grant you a personal, non-exclusive, non-transferable licence to view and use the materials and to adapt and reuse the exemplar wording in your own child's documentation, including documents prepared for your child's school, local authority or tribunal proceedings.

You must not reproduce, redistribute, sell, publish or share the materials (or any substantial part of them) with any third party, including in paid or public resources, training materials or other websites. Professionals may use the wording in documents for the individual children and families they support, but may not use the Site or its materials to serve multiple families through a shared account.

7. Not legal advice

The Site provides exemplar wording, educational guidance and signposting to legislation, statutory guidance and case law. It does not provide legal advice, and nothing on the Site creates a solicitor–client relationship.

The Site is not a substitute for advice from a qualified professional about your child's individual circumstances. You remain responsible for how you use the materials, including checking that any wording you adopt reflects your child's assessed needs and current law.

Where we refer to legislation, regulations, the SEND Code of Practice or case law, we do so in good faith, but the law changes and you should verify current versions at legislation.gov.uk and gov.uk.

8. Acceptable use

You must not use the Site for any unlawful purpose, attempt to gain unauthorised access to any part of the Site, scrape, harvest or systematically extract content, or interfere with the operation of the Site.

You must not enter any child's personal, identifying or medical details into the Site. The Site is designed to work with anonymised, template wording only.

9. Availability and changes

We aim to keep the Site available, but we do not guarantee uninterrupted or error-free access. We may suspend, restrict or modify the Site for maintenance, updates or reasons beyond our reasonable control.

We may update these Terms from time to time. The date at the bottom of this page shows the current version, and continued use of the Site after a change means you accept the updated Terms.

10. Liability

To the fullest extent permitted by law, we exclude liability for any loss of profit, opportunity, data or other indirect or consequential loss arising from your use of the Site or reliance on its materials.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

11. Governing law

These Terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them.

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in force.

12. Contact

Questions about these Terms, your membership or your account can be raised through senparentsupportgroup.org.

SEND Reform Alignment 2023–2026

Aligned with emerging SEND reforms, including National Standards and digital SEND plans, where evidence of need and provision remains central.

National Standards will still require evidence of need and provision.

Digital SEND Plans will still rely on quantified recommendations.

Tribunals will remain unless primary legislation changes.

Evidence remains the backbone of decision-making.
